Hallmark sues Dollar General over look alike gift bags
  Hallmark Cards Inc. has sued Dollar General for allegedly selling knock-offs of Hallmarks copyrighted gift bag designs in its discount stores.

The suit, filed Wednesday in U.S. District Court in Kansas, City, Mo., alleges that the Goodlettsville-based retailer is illegally selling nine styles of gift bags that are strikingly similar to those designed by Hallmarks staff of 700 artists and creative personnel.

Kansas City-based Hallmark seeks unspecified damages and is asking a judge to force Dollar General to pull the items in question from shelves for destruction. Hallmark also wants Dollar General to run ads informing the public of the issue.

Dollar General media spokeswoman Tawn Earnest said the company would not comment on the litigation at this time.

Ruben Carriedo, a product director of gift wrap for Hallmark, said he was running an errand in Overland Park, Kan., on Sept. 18, when he noticed the gift bags in a Dollar General Store there.

I was surprised to see an eye-catching display of six different gift bags merchandised as a collection which had designs that looked just like designs used on Hallmarks Peek-a-Boo gift bags, he stated in a declaration filed with the complaint.

Carriedo said that particular gift bag displayed a Hallmark design that features die-cut windows with acetate treatments with allow tissue to be seen through the “windows.Ã

Following his report, the companys attorneys purchased samples of nine Dollar General gift bags they claim are illegal copies, according to the complaint. Dollar General has been selling the items for around $1.

Hallmark said since 2001 it has sold 1.7 million of the gift bags, the most popular items in its gift wrap line.

Publicly-traded Dollar General, with 7,180 neighborhood stores in 30 states, also faced a lawsuit the past couple of years from American Greetings Corp. over its sale of toys that were similar to that companys Care Bear plush toys.
